Patrick graduated from the University of Texas School of Law in 1993, and joined Macdonald Devin in 1996. His clients include individuals, small businesses, and Fortune 500 companies. Patrick has been named a Texas SuperLawyer® by Texas Monthly every year since 2005. He is AV-Preeminent rated by Martindale-Hubbell® and is a Fellow of the Litigation Counsel of America Trial Lawyer Honorary Society.

Patrick is admitted to practice in all state and federal courts in Texas. He has tried cases to judgment in Collin County, Dallas County, Grayson County, Hidalgo County, Hunt County, Parker County, Tarrant County, Wise County and several Federal District Courts. He has also practiced pro hac vice in courts in Alabama, Arkansas, California, Florida, Illinois, Maryland, Mississippi, Nevada, New York, New Jersey, North Carolina, and Oklahoma. A small sample of his recent experience includes:

January 2015—Patrick represented a client sued in the United States District Court for the Northern District of Texas, Fort Worth Division. The plaintiffs alleged causes of action of trademark infringement, Lanham Act violations, misappropriation, unfair competition, and unjust enrichment. The plaintiffs sought compensatory damages, punitive damages and injunctive relief. After discovery and briefing by the parties, the federal court granted summary judgment in favor of Patrick’s client, dismissing with prejudice all of the plaintiffs’ claims.

October 2014—Patrick represented the defendants—an individual and his corporate employer—in a case tried in Grayson County. The plaintiff alleged permanent neurologic, lumbar and cervical injuries were caused by a collision with a truck operated by Patrick’s clients. The jury found that the plaintiff was primarily responsible for the accident, and the court entered judgment in favor of Patrick’s clients.

October 2014—In a case alleging the wrongful death of a young woman, Patrick represented the defendants—two corporations accused of non-subscriber liability. The court granted partial summary judgment, dismissing the non-subscriber claims against Patrick’s clients.

July 2014—In an adversarial proceeding, Patrick represented a company accused of trademark infringement and theft of trade secrets. After trial in the United States Bankruptcy Court, the court entered judgment in favor of Patrick’s client.

January 2014—Patrick represented the defendants, who were alleged to have caused the wrongful death of a young woman. The court granted summary judgment, dismissing all claims against Patrick’s clients.

September 2013—Patrick represented the defendants in a case brought on behalf of a young man who sustained severe brain damage and was rendered a paraplegic by a pedestrian/truck collision. The truck was operated by Patrick’s clients, who the plaintiff alleged negligently caused the collision. The plaintiff sought damages in excess of $15,000,000 from Patrick’s clients. The trial court granted summary judgment, dismissing all claims against Patrick’s clients.

Transportation

Patrick understands the transportation industry, having represented motor carriers and drivers in hundreds of cases. He is well versed in the requirements of the Federal Motor Carrier Regulations, and the customs and practices of the industry. He has an accident response team that is prepared 7 days a week, 24 hours a day, to document an accident scene and assure preservation of critical evidence.

Product Liability and Oil Field

Patrick has represented clients in lawsuits alleging defective design, manufacture and marketing of products. His experience includes representing clients in claims involving medical devices, pharmaceuticals, nutraceuticals, health care products, consumer electronics, heavy industrial equipment, oil field equipment, and building and construction products. On many occasions, he has represented clients in lawsuits arising from personal and property damages alleged to have been caused by negligence or defects in oil field equipment or services.

Corporate and Business

Patrick regularly consults with businesses regarding matters involving risk assessment, contracts, and dispute resolution. He has represented clients in lawsuits involving breach of contract, oil and gas royalty disputes, consumer protection matters, employment issues, non-compete agreements, fraud, conversion (theft), trade secrets, trademarks, and breach of fiduciary duty.

Since the beginning of his career, Patrick has represented physicians, dentists, surgical centers, hospitals and other medical entities and professionals in healthcare and business matters. He has been an invited presenter at the National Medical Association’s Annual Convention, Dallas Convention Center, August 2006 and Texas Medical Association's Annual Session, May 2005.

Mass Tort/Coordinating Counsel

Macdonald Devin has the experience and capacity to effectively represent clients in high volume, high stakes litigation. In roles as regional, national, and coordinating counsel, we have represented clients in litigation spanning the Southwest and United States. For example, from 2008 to 2011 we were lead counsel for several companies sued in Nevada by thousands of individuals, including a motion for class certification. The Southern Nevada Health District had ordered a written notification be sent to more than 60,000 individuals. The notification stated that each of the individuals was possibly exposed to hepatitis C at the companies’ clinics, and recommended testing and other action. Patrick represented the clients during the depositions of the plaintiffs’ experts and the representative of the Southern Nevada Health District. After Patrick presented oral arguments, the court denied the plaintiffs’ motion to certify a class action against the clients. Patrick and the rest of the team at Macdonald Devin also defended the clients in cases brought by individual plaintiffs.
