David retired from Simpson Thacher & Bartlett LLP, where he litigated complex civil cases and advised an international array of corporate, association and individual clients for 37 years from 1978-2015, 29 of those years as a partner.
David teaches Complex Civil Litigation at both Duke Law School (2011-present) and the University of Miami Law School (2018-present). He is the Chair of the Editorial Board of Judicature (July 2019-present), the more-than-century-old journal devoted to best practices in judging, issues facing the judiciary and the rule of law.
He is a Fellow of the Chartered Institute of Arbitrators (FCIArb), a member the Federal Arbitration Inc. (FedArb) Commercial Mediation and Arbitration Panel, the American Arbitration Association (AAA) Roster of Commercial Arbitrators, and the Institute for Conflict Prevention and Resolution (CPR) Panel of Distinguished Neutrals. He is also an ARIAS-US certified arbitrator and mediator. He has been appointed by parties and fellow arbitrators to serve as an arbitrator/chair on ICDR, ICC, JAMS and ad hoc tripartite arbitration panels as well as having been appointed as the sole arbitrator. In the insurance coverage area, he has been appointed by both policyholders and insurers.
David has also served as a Special Master, appointed by the court to help resolve discovery issues, and, at the request of all parties, to mediate the resolution of the case.
David is a member of the American Law Institute (since 1993); the Board of Visitors of Duke Law School (Chair 2009-2014); and the ARIAS-US Arbitrators Committee. He has served on the Board of Mobilization for Justice, Inc. for two decades (Chair 2000-2002; emeritus 2019-) and chaired the Product Liability Committee of the New York City Bar Association (2005-2008), which included some of the most nationally prominent MDL plaintiff and defense lawyers as well as law professors and judges. He served on the Executive Committee of UJA Federation-- Lawyers Division from 1995-2013.
He has been admitted to the bars of New York, New Jersey, Washington, DC and numerous United States District Courts, Circuit Courts of Appeal and the Supreme Court.
He received his BA degree from Duke University, summa cum laude, in 1975. He received his JD from Duke Law School in 1978, where he served on the Duke Law Journal.
