I am not a “number trader” type of mediator, but rather I am a “roll up the sleeves and dig in” type of mediator. I use every minute of a mediation and do not waste time. This has become my style because I have witnessed the financial and emotional toll that protracted litigation can have on the parties and their loved ones.
For over 35 years I have handled and tried cases involving wrongful death, brain injury, trucking, motor vehicles, premises, commercial disputes, employment, construction defect, toxic tort, products liability, fire loss, non-subscriber and many others. I prepare for each mediation by analyzing and not just reviewing the parties submitted materials. I press the parties at each step to more fully examine their positions, including their perceived strengths, weaknesses, misconceptions, emotions, fears, risks, and time constraints. By actively listening, asking pointed questions, probing risk tolerance, and economic options, I draw the parties towards the finish line of a final settlement. When necessary I will play “devil’s advocate” and will point out facts and legal issues favorable to the opposing side. As a result, parties can better assess their risk in deciding to settle or proceeding to trial. Trials always present a great risk. Settlement through mediation is almost always a better choice than the expense, uncertainty and inconclusiveness of a trial.
